Mackenzie Seiler, a Jimmy John’s patron with allergies to casein and dairy, went in to order lunch the other day — he asked for the restarurant’s Tom Turkey sub, minus the mayo. In a negligence lawsuit he’s how filing against the restaurant chain, Seiler claims he was served the wrong sandwich, a tuna-cheese-mayo concoction that set off his allergies after he ate it anyway. According to Seiler’s complaint, Jimmy John’s was negligent on grounds that they “permitted the ingredients of the food to include items not ordered by the plaintiff.” [Chicago Bar Tender]
