Giordano’s Crazy Bankruptcy Case Managed to Get Crazier

Most bankruptcy proceedings for restaurants are sad, boring affairs; however, Giordano’s bankruptcy ordeal has felt like a circus. Last time we checked in, former president, John Apostolou, filed a document which attempted to terminate the bankruptcy by making the case he and his wife were “free of any legal constraints” of the United States of America. The document had been written by Marshall Home, a member of the anti-government “sovereign citizen” movement. Home was convinced that he would eventually win the case and then get control of Giordano’s. Things got off to a particularly shaky start last week, as the Tribune reported that Home was removed from a Chicago courtroom after “making a vaguely threatening remark” to the judge. Now his plans are really screwed, as Home was arrested on Friday and placed in jail.

According to the Wall Street Journal, Home was arrested in Tucson, AZ, for a completely separate collection of court papers, which tried “to force the United States into bankruptcy.” The State of Arizona has charged him with two felony counts of “filing false claims in bankruptcy court,” and he could face up to five years in prison for both charges.

We’re not sure what happens next, but we’d just like to reiterate what appears to have happened here: a man attempted to delegitimize the United States government just so he could run a regional stuffed-crust pizzeria in Chicago. Let’s all think about this for a few seconds.
